Building Permits for Illegal & Unauthorised Building Works

Built an extension, carport, room or shed without a permit? We help you understand your options and bring the works into compliance.

Common unauthorised works

  • Extensions and enclosed verandahs built without a permit
  • Carports, garages, sheds and pergolas
  • Internal walls removed, rooms enlarged or partitioned
  • Converted garages and granny flats
  • Works found during a property sale or council inspection

Building rules in Victoria

Under the Building Act 1993 (Vic), most structural building work needs a building permit issued by a registered building surveyor. Where work was carried out without a permit, the council or a building surveyor can issue a building notice or building order requiring the work to be made compliant or removed. When you sell, the vendor statement (Section 32) must also disclose relevant building permits.

How we help

  • Consultation – we review what was built and explain the realistic options.
  • Inspection and assessment – we check the existing structure and its adequacy.
  • Drawings and structural design – we document the existing works and design any upgrades required.
  • Permit application – we prepare the documents for your building surveyor and support the permit process.
  • Rectification works – we can help organise tradespeople for any work needed to achieve compliance.

Why act early?

Unauthorised building works can cause problems when you sell or refinance your property, with insurance claims, or if council issues a building notice or order. Getting professional advice early usually gives you more options and lower costs.
